All transport is undertaken subject to the Irish Road Haulage Association (IRHA) Conditions of Carriage and, where applicable, the Convention on the Contract for the International Carriage of Goods by Road (CMR Convention).
Goods are accepted for carriage & sub – contracted subject to IRHA Conditions of carriage
By booking or using our services, the Customer accepts these conditions.
1. Cargo Weights & Dimensions
- Quotations are based on the accurate weights, dimensions, and centre of gravity (CoG) of the declared cargo.
- Any discrepancy may result in extra charges, delay, or refusal of carriage.
2. Suitable Equipment & Access
- The Carrier will provide equipment based on declared information.
- The Customer must ensure suitable access, exit routes, and hard standing at loading/unloading points.
- If site conditions are unsuitable, additional charges or refusal of service may apply.
3. Permits & Compliance
- Movements are subject to the receipt of all necessary permits and authorisations.
- Hazardous or abnormal loads must comply with ADR and Irish Dangerous Goods by Road legislation.
4. Loading & Unloading
- Unless expressly agreed, the Customer is responsible for loading and unloading.
- The Carrier accepts no liability for damage arising from loading/unloading performed by others.
5. Waiting Time
- Each vehicle includes 2 hours free loading and 2 hours free unloading.
- Waiting beyond this is chargeable at the Carrier’s standard hourly rate.
6. Cancellations
- Cancellation of bookings may result in charges for reserved equipment, permits, and preparation costs.
- Cancellations are charged at 25%of the job value if cancelled 48 hours before the organised collection & 50% 24 hours before the organised collection
- Jobs cancelled on the day of collection are charged at the value of the quoted job
7. Liability & Insurance
- Carriage is at the Customer’s risk, subject to the liability limits of IRHA and CMR conditions.
- Our liability is strictly limited under IRHA and CMR rules unless additional cover is agreed in writing.
- Customers must request extended insurance in advance if required.
8. Claims
- Any claim for loss, damage, or delay must be notified in writing within 7 days of delivery (or expected delivery).
- Legal action must be commenced within 9 months, in line with IRHA/CMR conditions.
9. Exclusions & Additional Costs
Unless included in writing, quotations exclude:
- Sheeting/covering cargo.
- Police or escort vehicles (BF-2/BF-4 or equivalent).
- Route surveys, bridge calculations, and engineering works.
- TÜV checks, roadbooks, or similar inspections.
- Provision of dunnage, cradles, or supports.
- Removal/reinstatement of street furniture, overhead lines, or trees.
- Customs duties, VAT, taxes, and documentation.
Extras are charged at cost + 10% administration fee.
10. Cross-Border (UK) Movements
- The Customer is responsible for customs declarations, duties, VAT, and compliance.
- Delays from UK customs or border checks are outside the Carrier’s control.
- It is the responsibility of the exporter /importer to provide the correct documentation in advance of cargo collection
Specific charges (permits, tolls, emission charges) are passed on to the Customer.
11. Payment Terms
- Payment is due within 30 days of invoice, unless otherwise agreed.
- Late payments may incur interest under the European Communities (Late Payment in Commercial Transactions) Regulations 2012.
12. Force Majeure
We accept no liability for delays or non-performance caused by events outside our control, including weather, strikes, legal restrictions, or road closures.
13. Jurisdiction
These Terms are governed by the laws of the Republic of Ireland. Disputes will be subject to the exclusive jurisdiction of the Irish courts, unless otherwise agreed.
